debt Liability - Am I responsible for my spouse's debts?
In general, spouses are not responsible for each other's debts. Each spouse may obtain a separate line of credit and borrow money separately in his or her own name. Of course, if spouses co-sign for a loan or take out a line of credit in both of their names, both are responsible for the debt. Many states recognize an exception to this general rule and hold both spouses responsible for a debt incurred by one spouse if the debt constituted a family expense. Examples of family expenses include child care, groceries, or health care.
In some cases, marital Property may be divided to pay one spouse's debt, using that spouse's share of the marital Property. In community Property states, spouses are generally responsible for each other's debts. This is consistent with the equal rights both spouses have to each other's incomes.
