If you can't find your spouse.
Sometimes it can be difficult to inform your spouse of the divorce. This will depend upon state family law, but states usually provide that if your process server has tried unsuccessfully to deliver the complaint personally, it may be left at his or her home or usual place of business, and then mailed to him or her at that location.
As a last resort, you may be able to get a court order allowing you to publish the summons and complaint in a newspaper most likely to give your spouse actual notice of the divorce. To get such an order, you will likely have to show the judge that you made every reasonable effort to find your spouse.
