Witness Declaration and Notary Acknowledgment Requirements

Witness Declaration and Notary Acknowledgment Requirements

The Declaration of Living Trust as well as most of the other living trust documents and forms must be signed before a notary public or other public officers authorized to administer oaths.

There is however, an exception to this requirement, and that is:

  • If the Declaration of the Living Trust is established in the State of Florida, then it must be signed in the presence of two witnesses rather than before a notary public.
  • Also, the State of Florida requires proof of identity when signing before a notary public, and therefore, such proof must be indicated in the notary acknowledgement.
