Separate Property is generally Property that a spouse owned before Marriage or Property he or she acquires during the Marriage but as a gift or an inheritance. Most states follow a traditional system that treats each spouse's individually earned income as separate Property. Each spouse can control his or her own separate Property. This means that only the spouse who owns the Property may sell, give away, or borrow against the Property. If this separate Property is shared or mixed with marital Property, however, then it may become marital Property. The lines here become fuzzy, though, and usually have to be settled on a case-by-case basis when there is some dispute. A few states follow a different system. These states are "community Property" states.
