Nebraska Marriage Amendment Challenged by Lambda and ACLU.
The Nebraska Marriage Amendment was challenged in federal district court Wednesday by Lambda Legal Defense, a pro-gay Legal organization, and the American Civil Liberties Union. In the case, Citizens for Equal Protection, Inc. v. Attorney General, plaintiffs argue that the Nebraska constitution violates the guarantee of equality contained in the United States Constitution. Specifically, the complaint alleges that the Nebraska Marriage amendment, defining Marriage as a male-female union and prohibiting state recognition of civil unions, domestic partnerships and other "similar same-sex relationships," unconstitutionally bars homosexuals from "using the ordinary political process to seek important Legal protections."
Advocates on both sides of the issue have been anticipating the lawsuit for more than two years, after the ACLU board of directors voted to challenge the amendment in November 2000, just days after Nebraska voters had ratified the Marriage amendment by a 70%-30% margin.
