Massachusetts Marriage Amendment Needs Grassroots Support.
Testimony from numerous supporters of the Massachusetts "Marriage Affirmation and Protection Amendment" (MA&PA) last Monday outlined the importance of Marriage to society and the national conflict which would follow were the Massachusetts Supreme Judicial Court to legalize same-sex "Marriage" this summer. Despite endorsement from both the House speaker and one co-chair of the committee, the bill failed to garner a majority 9 of 17 votes on the committee. Without majority support, the proposed amendment was reported out with a default negative recommendation.
Throughout the hearing, opponents of the amendment argued that that it would prohibit extension of domestic partner benefits by private employers and limit individuals from entering into private agreement regarding Property and testamentary provisions. The measure's supporters, however, asserted that the amendment should be read only as a definition of Marriage and a preemptive ban on Vermont-style civil unions. This conflicting testimony appeared to confuse legislators, who requested briefs from the Massachusetts Gay Lesbian Bar Association and from a pro-Marriage Massachusetts law professor explaining the issue.
Having been reported out of committee with an adverse recommendation, the amendment will need strong grassroots support through e-mails, faxes, letters and phone calls to legislators. If the amendment receives majority support in constitutional convention both this year and again in 2005, the amendment will go to the statewide ballot on November 7, 2006.
