Judge Finds Marriage Case Fails to Challenge Law.
In an effort to build upon the South African Constitutional Court's judicial recognition of same-sex couples for purposes of adoption and pension laws earlier this year, two women petitioned the Praetoria High Court to grant them a Marriage license. In a ruling this week, High Court Judge Pierre Roux ruled that he could not strike down the current Marriage law as the couple had failed to challenge the law in their complaint. Rather they had simply asked the court to grant them a Marriage license. In light of the narrow request, Judge Roux ruled that his decision is Limited to the question of whether to grant a Marriage license to the individual couple. It is not yet clear whether he has decided to do so.
